    The frustration of EB3 folks is very visible and I might get a bad rap for my post. But I wanted to share a few thoughts , if you will:

    I fully sympathize with EB3I folks. Of all, you have been waiting longest. But were you really expecting a miracle in this Visa bulletin? Or are you more upset now that EB2 has moved forward significantly and EB3 has not? This is not a criticism , just a question.

    Secondly, given the reality, I would say with lobbying etc, let me advise you that you ask your employer to start processing EB2 application for you and then use PD porting. With number of years you have spent in current job, I would advise you try and impress on your employer to do this urgently. If this does not work out, I would say you can look for another job. (This would apply to those who are in permanent job and not paying out of their pocket for GC). I mean with so many years in the same job, you definitely qualify for promotion. If I were you, I would not take the corporate BS.

    It is also a matter of numbers. If you are the only EB3 person from your company then you are probably screwed, but if you have a few employees, then you network with them informally and then press as a "group" on your employer.

    I have always been a supporter of EB3 to EB2 porting and even when I was not current, I did not oppose it. While there are other avenues such as lobbying, lawsuits etc, it takes a lot of work and at the end of the day benefits are not really tangible. I would suggest you guys make full use of the door that is open, EB3-> Eb2 porting. It is in your hands to get this done.

    Its kind of confusing to make a one time donation.. and there should be two more options of $25 and $50 for one time contribution....

    Can anyone tell me how to contribute one time and for the amount not mentioned on first page..

    I think we should follow Hillary and Obama's grassroot campaign, whereby asking for smaller amount and that way make people more willing to contribute in smaller amounts...

    Well, it is all politics. All they can see right now is 12 million ill-legal people who will some day vote for some party. That is a big and growing vote bank which they can not ignore. Who cares for people like us? NO ONE. We are less than 0.5 million, most will probably never show to vote if granted citizenship. No one gives a dam for taxes we pay etc. The only chance that we could have is with the big corporations, but they too are quite for now. Jobs will simply move to other parts of the world.

    Current generation of politicians here simply do not have the foresight. Reminds me of back home where politicians use to give out blankets to the poor before the elections to win votes.

    May be it is the best for us that this bill has stalled, may be IV will have better luck next time. Let us all wait and see.

    They filed my H1B and are about to start my green card. The H1B took forever. I wish my company allowed me to do the H1B myself. I can do a better job without a lawyer instead of paying Fragomen $5000 for rubbish.

    Once, they kept sending out emails per my H1B application and copied my company using a wrong email address. This stalled my start date as my company never got these emails and I kept calling them. I thought my company was ignoring me but it was Fragomen that kept using the wrong email address.

    I wonder if my company would allow me use a personal lawyer for the GC process.

    Its funny how some so called indian "newspapers" like siliconIndia are very religious to echo the "statements" and "Sentiments" of these people from other countries. Again, this article states "it is said...bla bla", they are talking as though it has become an epidemic and all the billion plus people from India are gonna follow to their greener pastures. Yes, these countries can do what they need and can do, but for God's sake, dont paint a sorry a$$ picture. They jsut continue to show how ignorant and foolish they are :)

    It's a money making scheme. Couple of weeks ago read a report about UK taking the begging bowl to the IMF and World Bank and an increase in the poverty level. You have so many people on dole on a small island, it's a natural progression that they try to find other avenues for making money. Why do you think they have the transit gates situated such that everybody has to pass through Duty free in Heathrow?
    The robbers have exhausted all their loot and now want more. :rolleyes:

    Assuming no relief for immigration system as a whole, EB3 India will move forward substantially only during last quarter of the FY.

    Rest of the times, it will be in 2001 or 1999 or even pre-immigration years. You never know.

    The least preferred category among EB (taking the country tab in to account) is EB3 - India.

    Isn't that a privilege to us?

    I think many of us go through these kind of tragedy. One of my friends got laid off last month and his employer did not give him the letter to file I-485. Now he is back to the line where he was way back in 2000. He has to start his whole immigration process all over again. This guy lost job twice just before he could adjust his status. He is in USA from over 10 years now and he holds nothing but a PD of 2002. There is nothing in US Immigration Law to protect folks like him. What a shame to the US Immigration system.

    This may happen to many of us, not only on the job front, anywhere down the line, untill we get our Green Card. For example, what if USCIS reject our application at the end moment, or else what if USCIS deny our I-485 for a reason beyond our control; there are tons of reasons, our life is shaky until we get our green cards.

    Would that be nice if we ask something to protect us just like AC 21? For several folks, even to get to the stage of AC21 is a big milestone. Is it not the time to ask congress to protect all H1-B holders who play by rules and who are here over 10 years, with something similar to AC21? When they can consider giving green cards for those undocumented who are here since only 2005, what we legals ask for; besides just play by the rules and stand in the line and leave everything at the mercy of the adjudicator?

    There should be some protection for those who come under these unforeseen clutches of law, besides fighting for mere retrogression.

    I just filed i-485. My pD is Jan 2004
    i-140 has been previoulsy approved. I was laid off but my original employer agreed to give me evl, but with the way the economy is going they are not doing well.
    I have another employer which I am working now with.
    How likely is to get an approval (or an rfe for paystubs?) before 180 days.

    I guess irrespective of which loc u get services from, they are louzy people. I had terrible experience with them. They take their own time to do anything(all counted in months). If you dont keep checking what happened to ur petition, its highly likely that files went into some waste bin!
    But this helps employers, as does slow emmigration processing.
    Though we have number power, all of us are helpless when it comes to lawyers.

    Beggars are not choosers!!

    BTW Paul hastings has been RESEARCHING for PD substition for me for last 3-4 months. So it looks all lawfirms are as good as another!

    I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?

    You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
    1. Get a Ph.D, get a job in a univ and apply in EB-1.
    2. Get a MBA and get a management job and apply in EB-1.
    3. Become a religious worker in some temple and apply in the religious worker category.

    EAD is issued to ALL 485 applicants based on pending I-485. As far as I know, "pending Adjustment of Status application" is the only criteria for 485. That means both the primary applicant and the spouse will get EAD irrespective of whether dates stay current retrogress as long as you applied for I-485.

    Guys who got NOID/Denied 485, quick question.

    Looking back, do you think it was worth making the job move using AC21? Is it really worth the time, money, anxiety, sleepless nights that you go through during NOID-MTR?

    For people getting layed off, they have no choice but to use AC21, but for rest of us, why not continue with the job you are currently in and let the GC take its turn rather than risking it?

    PS: I am in US for past 5 yrs with May06 PD. I am just trying to get an opinion here, so don't flame on me. I was comtemplating on using AC21 but reading all the NOID stories, i am bit hesitent now.

    IV is a voluntary organisation. You can request people to volunteer, but cannot force them or scold them for not volunteering. This is not professional. They might have their reasons and the right to work their way. I agree with your frustration when people who signed to turn up do not show up. But I feel this is not the way to express it.

    Since Senate already passed the CIR, that included the SKIL, Is it required to vote again in senate if the house somehow passes the SKIL bill?
