Republicans are generally more amenable to legal immigration fixes than Dems. While not all of the Dems are bad, most of them dont care about legal immigration -- they just want the illegals. If it were not for these Dems, 5882 would have sailed through by now

With respect to immigrant visas, the amendment would restructure the proposed merit-based program to add several of the features of the current employment-based system. In addition, the amendment proposes an additional 140,000 immigrant visa numbers for employer-sponsored merit immigrants, and would create a quota exemption for certain highly skilled immigrants who have at least three years of U.S. work experience. Regarding the H-1B program, the amendment would eliminate the 20,000 ceiling on cap exemptions for foreign nationals holding advanced degrees from U.S. universities and create a new exemption for foreign nationals holding foreign advanced degrees in the sciences, technology, engineering or mathematics. The amendment would also dispense with the Senate bill's expansion of the recruitment and non-displacement attestation requirement to all H-1B employers.

I recieved my I-140 receipt notice finally from Nebraska Service Center, it does not have the A#, may be due to the fact that I belong to EB3 category.
As one of my friend who is in EB2 category has an A# on his receipt notice which he got yesterday from Texas Service Center.

you are half right, the country quota laws were put much earlier than the off shoring companies, but remember that the retrogression only started in the last 10 years when those companies came in the picture and skewed the lines .. that's ur cause and effect!
I am in software and would be satisfied with resticting this rule to the software field, but feasibility wise, rules won't get micro-tailored this way.
I always tell myself i shouldn't go on with the discussion, but here i go again..

And besides these companies are all software cos that came up in the last 10 yrs, why should that stupid rule affect any person in a non-software field?
Yes we know that the current rules make the journey longer. The point is that it is unfair and that's why we should start trying to change it!
Basically it is very difficult to understand another person's pain. Especially when you're set up to gain from it.

I am in a lot of stress. Please help out if possible.
Six years on my H1B expire in April 2008. I just got laid off from company A. My last day of work will be May 31st. I have LC and I-140 approved with company A.
If I join company B starting June, and transfer my H1B to B, can it extend my H1B beyond 6 years based on the approved I-140 I had with company A? If yes, will it be for one year or three years?
Gurus please help. I will be grateful.

Is it possible to upgrade from EB3 to EB2, if person is working on EAD after AC21 is invoked and H1 is expired?
I believe it is possible if your company is willing to do it. Having said that, you would be better off asking this question to a qualified lawyer.

oooohhhhh by the way they never should ask money for this public service. They are just playing with us. There are similar things happened with USCIS and they got strong and angry reply from congress in the past. That is why we collectively need to contact congress...I wonder why IV is not forth forward in this effort from the gecko???
