i think it's not quite that simple.
there is no doubt that lack of numbers is a key key issue. but letting uscis off the hook when they have failed to process 269,000 Green Card numbers since 1994 is not kosher. that is >20% of the backlog right there.
my straightforward NIW application based on national interest service not exceptional ability (which may be more subjective) will take almost a year to process. wow....!
uscis also takes the narrowest interpretations of any law- even when it clearly conflicts with the law's intent- then it takes a lawsuit to budge them- speaking from personal experience and the loss of 4 years in PD in an India line...believe me this is not an agency i feel like defending.

It would be really easy for me to blame USCIS inefficiencies, but let's look at the whole picture. My second H1 was approved in 1 day (premium processing), my I-140 was approved in 9 days (not premuim processing), I got my fingerprint notice and RFE on I-485 a month after I applied - that means the case was looked at, determined what else they needed, and everything was processed. Work on my AOS case was over 4 month after applying (and I did apply concurrently). Then, I had to wait for namecheck... and wait and wait. Do I blame the processing center for that? No, it's not their fault. Do I blame Chertoff for that? Sure! He is the one who's supposed to negotiate things between DHS and FBI, and make sure things work well together.
Now, we come to a different issue - quotas. It is obvious that USCIS is not good at all at managing quotas. I am in management, and to me the task of getting within 100-200 approvals on 140,000 quota does not appear Herculean. It's a very predictive process, so theoretically it should be easy to get to right numbers. My take - USCIS system is built in a way that does not allow them to understand and manage the flow of petitions - and forecast how many will be ready for approval in any given month. That's a big flaw, but you know what is the best way to fix it - to relax quotas. Then, they would not have to triple-check every petition to make sure it's current and it is its time to be approved. Having quotas adds a lot of complexity that CIS can't manage. If you look at the immediate family petitions, that do not have quotas, they are getting approved in 3-4 month, so one part of the system works fine, and the other does not.

The Point system that this bill refers to is a BS , look at even canadian system they differ upto some extent on these. But the key point is this bills retroactiveness , it simply puts all those ppl stuck in BEC out of scope , the point system is not tried too , just becoz the managers of these senators thought this is good by getting a hybrid point system of Canada, Australia and UK is good enough ? This point system is worse than current sytem no matter what ever it might be good for some but logically , technically its flawed

Is it possible to upgrade from EB3 to EB2, if person is working on EAD after AC21 is invoked and H1 is expired?
I believe it is possible if your company is willing to do it. Having said that, you would be better off asking this question to a qualified lawyer.

Hi ,
I have a my my case in pending state for H1B transfer from company A to company B.
Pending status h1b with company B.
From Company A : I got the Labor and I140 Approved.
I m trying to file my 485 through comapany A- But my employer says that I need to have new H1B with him- Cos his company merged with another another company.
Can someone try to help me on it:(
H1 and green card are seprate things. H1 is for current employement and green card is for future. If down teh line you can come back to employer A you should be fine. Although all this can generate a RFE. Please consult a lawyer. I recommend Rajiv.

I am very sorry to hear about your case. As others are pointing out - it is not all over yet. Make sure you get in touch with a good lawyer and take a good route to fight USCIS.
Also, could you please let us know of your PD? Doesn't look like you are current right?

Please understand that your older PD is much more important because u would get ur gc that much earlier compared to 2005-07 people. Just because ppl are able to file 485 does not mean that they are going to take a number out of the quota for that year. The numbers are only taken during approval and hence they would all still be stuck in the same queue and you would have gotten an oppurtunity to file and possible get your GC too...take a deep breath, relax and think about this with a cool mind. I definitely do feel bad for you. My labor was stuck in BEC too and i left my company and joined a new one and restarted all over again. Been on H1 for seven years without ever getting any chance to file 485 until now...

I had applied for I-140 in march 2007 in regular processing (not premium). its in nebraska center which i think is taking quite a long time. should i hurry this up by upgrading to premium and then apply for 485?? i dont want to wait cuz who knows those 485 dates might retrogress in a couple of months.
i wud highly appreciate any recommendations/suggestions.

This is the most stupid thing i ever heard. sorry if i offended you by saying this, but i myself wish you should be first in the line than me. We(most of us whose pd is later than yours and most of you guys) wish sincerely that you people should get GC before we get. No one opposing your cause, but we are asking to think one more time whether you'll get any benifit from this. IF YOU THINK "YES" PLEASE GO AHEAD, but dont curse or use any kind of bad words, not appreciated.
Very few members of IV are stucked at backlog, so what i suggest is talk to core personally about your cases, ask them to help you guys in finding out what happened to your cases, if a person with pd 2005 got approved and 2004 is stuck means there might be some problem with the case filing, if not yours, your attorney might have done some mistake or so. so i personally think you should talk to core and find a way to solve this problem.
Although, some people may call it SELFISH AGENDA and advice not to use IV platform, I strongly support the cause. Some people may advice that once the labor is cleared, people with 2001/2002/2003... PDs will be at the front of the line. But, when those old labors are cleared, will they be able to apply for I485? DOL may say that by September 30 the backlog will be cleared. Is there any gurantee? Even all are cleared, they will not be able to apply for 485 now (has to apply by August 17). I think some SELFISH people with recent PDs are scared as people with older PDs may take the quota.
Regarding IV platform, it is an organization for the GC sufferers and by the GC sufferers. So this is of course the right place. If IV is busy with other issues, then people have to start their own fighting.

I understand that you guys are frustrated but I did not open this thread to make empty noise. I have written to six different organisations and ACLJ only gave me a reply that they would be unable to process our per courntry quota lawsuit. There are thousands of federal court immigration lawyers in the country who would do this lawsuit albeit with more money than these non profit organisations. If any of you guys want to make a difference in your lives and lives of others pls co-ordinate this event of contacting various immigration lawyers.

Well, it's time to break the news.:p I didn't attend the rally because
(1) the first and foremost reason: a recent surgey at my backbone , and I may not be able to walk for more than 15 minutes continuously.
(2) the second and honest opinion: Even If I were doing well, I wouldn't have attended the rally due to the yelling-nature of words from some of the Core leaders, and their pushy messages.
(3) the third and final point: The rally pictures and the rally experience of other members have impressed me very much and have totally changed my mind. So, next time, whereever you organize the rally, I will be there.:p
This is my honest opinion about my abscence. I hope noone will jump on me for my reasoning.

i have engaged with him more than once. he complains about someone or the other being rude on a non-stop basis. i would like to hear from him which core members has yelled and posted pushy messages. most of us desist from such actions most if not all of the time. actually he probably has no clue who core members are. after all it's not announced on the July 2 filers thread. in the past inskrish walked around with a red square to his name and accused me of being responsible for it. maybe he needs to see how many comments he gets in his user cp. interestingly enough i may be responsible for the green. this kind of passive aggressive behavior is not going to be of any help whatsoever to us.
i'm glad to hear he has a change of mind. but i will believe it when i see it. so far i see no change in the constantly complaining-accusing tone from him. words matter. constantly putting down others and acting superior is not constructive to an effort that is voluntary- each one of us- and certainly you franklin- have given up a lot to push this effort forward. words from the likes of inskrish do make me wonder why we bother.

You should show some decency in replying to posts. Otherwise it reflects where you come from. - I come from a down to earth broad minded background where "we" together help and try to make lives better, .. but I am skeptical about you and your background because thats a selfish, mean and free loader character.
By donating few dollars, you are not entitled to write anything on any forum. If you think that a thread is not for you, you should not post there.- Atleast I donated something , and I never brought up the point of donation, you were the one who came at me first saying, "Sell you plane and donate IV" It seems you have a problem with the people with the tag "Donor" and that is for the reason that your self conscious is making you feel ashamed of being a free loader.

But why dont you start a local chapter and do some field work instead of just writing a check and claiming yourself to be a superior guy to others.

They have to do those work anyway. Because all the applications are not I-485 and also some ppl filed I-140 along with I-485. So, they do have to repackage those applications. Let us see,how events develops for couple of more days?.

i would like to move away from the focal issue of rally participation for a moment- only to broaden the question. yes i perfectly realize that there are many motivated members that had genuine compulsions of various kinds that did not allow them to consider being in DC. i could be one of them tomorrow. i also know that they are not the majority of non attendees. still, to again answer a previous question, 2,000 registrations was a pretty good number from a crowd that likes things handed out to them. my question though is related to other iv activities. going to a rally is a bigger decision, true. so how many of those who are espousing moralistic platitudes about "cheapening" and "not associating real people with userid's" or blaming chandu's words have participated in other actions? have you joined a state chapter? are you active in it? did you attend a meeting if you belong to an active chapter? if you have no chapter did you volunteer to start one? did you volunteer for pre rally activities? have you met your local lawmaker?
i could go on, but those are key questions. those who complain about trivia need to step up and show their own commitment. the way of this country is to petition government by lobbying your lawmakers. nothing cheap about that one. in fact it's an incredible experience, open and educational to say the least.

Everbody's posts here are speculations on what USCIS will do to I-485's filed on or after July 2. Everybody is trying to get an answer from USCIS. You called and got an answer DIRECTLY from USCIS which you doubt and don't believe. So what you want is for people here, who can only come up with speculations as to what USCIS's action would be, to confirm what USCIS already told you???
