I have mailed 17 more individual signed letters to WH address this afternoon and copy of these 17 signed letters in one envelope to IV address. Good to see new date. I will continue to get as many as I can before this new date.

I wish there was a better way to establish priority date other than an approved I-140. Anyways...
I am worried that if I get laid off or other people at our site are laid off, how will it affect my I-140 processing which is pending at TSC? Has anyone been denied I-140 because of layoffs by the company?
The company said they will not revoke the 140 application and will send me the approval if it comes later (so I can at least retain the priority date if I have to do this all over again at a new company).
Another thing that worries me is that the company is refusing to do premium processing of the I-140 application, even if I am ready to pay for the premium processing fees. I am at loss how to convince their dense mind what it means to lose the priority date.
This sounds unfair. Because of the backlogs, you have waited 6 years. Now you got laid off and you lost everything. Would that be the situation if there was no backlog and you were able to get your green card within, say 2 or 4 years?
I think those government agencies should take responsibilities and compensate for your loss.
Anyone thought about that?

Thats good news. Hope it works. My feeling is that EB category will have more support in the Senate if they dont overdo the helpful provisions (read cap exempt etc..).
Fragomen Website talks about the bill and the amendment to the bill to reinstate most of the SKIL bill provisions. Perhaps, this amendment will be considered in the senate.

I am very glad that you brought this point. Nothing would give me greater pleasure than suing the DOL. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter and deliberate disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on the DOL web site that they have tried to maintain FIFO, it makes me feel like puking.
Some folks have pointed that the lawsuit is not worth, as it has little chance of winning. To me personally, more than winning or loosing, it is a matter of bringing injustice to the light, as Gandhi has said something in this line: First step against injustice is to make it visible. This law suit will bring public scrutiny to the misdeeds of the DOL.
Even if all the backlogs get cleared by September 2007, severe damage has been already dealt to our lives. Though I am close to getting my labor clearance (I filed RRI few weeks back), I am strongly in favor of continuing with the law suit even after getting the labor clearance.
Let�s get IV�s attention and support in this area. Let�s talk to AILA. Let�s write letters to senators and house representatives (congresswoman Lofgren may be good person to start with). Let�s write to media personnel. Let�s do whatever needs to be done to expose this insult and injury to the immigrants who waited in the line for years and followed rules of the game.
I would strongly suggest talking personally to IV leaders about this. These are folks who by now really have a feel about how things are handled out there. They will suggest the best way to tackle this issue and am sure with their mature guidance, this is a very simple techinical issue that can be resolved. You are literally just saying "SIR, I WAS HERE BEFORE. I KNOW YOU ARE BUSY AND POSSIBLY FAILED TO NOTICE ME, BUT HERE I AM, AND I HAVE BEEN WAITING FOR LONG TO GET YOUR ATTENTION". honestly I dont think even USCIS wants to hurt you purposely, its just that the traffic of new PERM thing has overcrowded their desk and mind so they have shelved your applications unknowingly. PLEASE SHOUT OUT----THROUGH IV ONLY. let them realize that we have a strong organization and ONLY ONE STRONG ORGANIZATION.

So, I made copies of the notice and put together cover leter and asked to be rescheduled for Sep.
Will call next week to follow up. In the meantime I noticed soft LUD on the date of my supposed biometrics....but the online message still says document production ordered....

Totally agree with you. I know guys who worked in production support and QA applied in EB2. At the same time people like me in positions such as Architect went with the ill-fated EB3. It is sad, but is the truth.

Ask yourself this question: (assume that you are american born person and are advisor to one of the campaigns): What will help you politically? Supporting skilled EB immigrants (140k per year, who will not be able to vote for at least next five years) or FB immigrants (860k per year, who may also not be able to vote for next five years) or no immigrants (join the part of Loo Doggs and count on may be 1-2 percent of population who may support them which would be 3-6 million votes).

I have to admire the unbelievable energy and commitment of you guys. Especially those who organized the rally and to some extent those who attended it from far away are probably tired and catching their breath!
We need to have some creativity and strategy in our next step. Rally after rally probably is not the best way to get that, the so called law of diminishing returns. The flower protest for example gave us a lot of visibility and media coverage since it was something intriguing and new. It was fairly inexpensive and got us the kind of coverage we wanted and arguably results that were out of size with the effort.
I think we need to think outside the box and have one more high publicity event. Another rally is certainly an option for later should legislative action heat up. I'm hopeful the upcoming legislation will allow someone to introduce friendly legislation. I am sure IV's lobbying advisers will have some input on timing etc. and I am pretty sure organizations like compete America etc. also will use this to push their efforts as well. IV core ought to be in contact with them.
A few very important things came from this rally. Firstly, that we can organize such an event, in no small part due to such a committed and capable leadership team. We got fairly good media coverage in highly visible newspapers, that covered not just the event but also some of the issues facing us in clear detail. Finally the lobby day events were definitely very good. I was amazed that 150 meetings took place.
To put this in context, large national organizations of some professions have these lobby days sometimes, and they do well to get about 100 lawmaker meetings done.
One thing I wish to add is that we must develop a good way of sending out many letters at will/as per the strategy of IV core to the lawmakers at critical times. We are 23K strong. Surely we can get atleast as many letters sent in to lawmakers at critical times. If you can't send a written petition to a lawmaker then I doubt it makes any sense to even think you or anyone can alter your fate, in that case time spent on sites like this is for what reason?
Professional organizations do letter campaigns all the time and get a good response. If everyone moves on these issues it does create a splash and can bring visibility and attention.

If USCIS realizes their mistake and revokes an approved I485, will they also take the necessary steps to restore the previous status of the applicant? i.e. H1/H4/AOS/EAD or what ever the wrongly approved person had prior to the approval mistake?
I am also worried. I called my attorneys office to inform them but of course like always he is in a meeting. I am sure this was an error but I am hoping its not call me optimistic but I like the smell of green card :)

Reading through this, this only says that the status cannot be changed (to a PR). It does not say that the prefiling of of AOS application cannot be done.
I think we should definitely try to work towards this. There was also an article on Immigration daily (http://www.ilw.com/articles/2009,0225-endelman.shtm) which suggests pre filing as a administrative fix that will solve a lot of problems. It argues that "there is nothing in the INA that compels a particular definition or understanding of what "immediate availability" means."
I am definitely in for such a initiative.

Has your company sent a termination letter to INS? Have they paid you for your travel back to India?
I may be wrong, but I think those two are necessary for an employer to invalidate a H-1.
Does anybody know how long an H1B visa can remain valid (including grace period) after a layoff ? What I know, is an H1B technically becomes invalid the day you stop rendering your services to your employer. The firm's lawyer suggested me to file for B1/B2 visitors visa to avoid going out-of-status.
