Guys, Due to all this mess up with dates I decided to file 485/EAD/AP myself and for my wife on 6/29; so filled up everything, attached copies, photos and what not and FedExed all to USICS on June 30 to hit them on 2nd July.
Now I see that by mistake I have put my SSN on my wife's 765. She has been always on H4, never had SSN.
1. What can be the consequence of this mistake?
2. Should I try to pull it back from USICS and submit again (if it's at all possible)

If PD is current when USCIS starts processing the applications, PD's doesn't matter. But if PDs retrogate (which will be the case most likely), then USCIS only going to process the applications which has PD current that time. I hope it makes sense.

Hi Frens,
can someone help me.
I am applying for H1 visa to the US. I got my passport in my graduation. So i donot have the ECNR clearance. So please can someone tell me if I will have a problem before applying or should I get it done now and then apply. I however have the Canadian visa stamped on the passport.

You must submit the 485 through a lawyer if your priority is current, check the visa bulletin. You can always file when 140 is approved and you are still employed with same employer. You can also file EAD & AP for work permit and international travel. Get a lawyer asap.

I recently graduated and got a job. I am currently working on OPT and the application for my H1 has been filed. I am looking at applying to some graduate schools for their online programs for working professionals. If I apply for these programs right now will my OPT be void?If my F1 changes to an H1 in October will I still be able to apply for the program without any issues?

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

Hi All,
Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

I would like to have an expert advice on the matter below:
I am working on AC21 under a company that is going to be bought over completely by another company at the end of March next year. The corporate attorney mentioned that effective 04/01/2010, my company will stop existing as a separate entity and all AC21 guys will need to re-file their AC21 with USCIS (of course, submitting AC21 is optional).
We are planning to visit India for a month or so (my wife might stay there for longer) in the beginning of March next year. We have a valid Advance Parole until 08/31/2010 to re-enter USA. We obtained this Advance Parole when I was still working with the employer who sponsored my I-140.
Some questions
-- Is it safe for us to come back to USA after March 2010?
-Or shall I first file AC21 with the new company and then, leave USA?
I am the primary applicant of our 485 application and my wife's 485 is dependent upon me.
Please let us know so we can plan our trip accordingly.

hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?
