Your company's HR/legal should be able to give you an answer on how to reply to the NOF. I think they just have to show that they need you in the location that they put on application. Just make sure that EVERYTHING on applciation pertains to that same location - i.e market wage rates etc etc. If for some reason they do not have experience in these matters, try and get a hold of that NOF and go see a real lawyer. And word to the wise - be prepared to pay a little for the advice that you get. You always pay for what you get- so don't go to some 2-bit lawyer who will charge you $100 for answering questions when you can pay $200-$250 for someone who will give you worthy advice.

H1-B quota got filled up on May 26, 2006. You have to wait till April 1, 2007 to apply for H1-B, unless the company falls in the exempt category (non-profit, university...). If the SKIL bill is passed in the lame duck session it can change things as well.

I recently got my I797 approved (on Oct 19) but, the USCIS denied my extension of stay, and I need to go for stamping in Chennai (as per I797). My question:
1. Can I attend the interview in Canada/Hyderabad consulate instead of Chennai. Company attorney said that should be ok and filing I824 for change of consulate would take long.
In case you wanted to know more details about my case:
-Possess I797 from Employer A until Nov13, 2009.
-Filed for H1b extension with Employer B in Feb, denied in Jun15. payroll with Emp B Feb onwards.
-Re-filed for extn with Emp B in Aug4 finally approved on Oct19 but denied extn of stay.

Rediculous, the processing times say it takes 90 days minimum. Hopefully they will give the extension from my expiry date which is Aug 28th 2008.
As USCIS is saying they will issue 2 year ead starting Jun 30. certainly I will not get a 2 year EAD.
Yes, the new EAD will be issued with a start date of your current expiration date.....

what is the best way to do a change of address with uscis for pending applications ? I tried online changing ar-11 and for each individual case nothing seems to be getting in effect, my FP notice still gets forwarded to the old address. I also even called the uscis customer service and changed it , still no luck. any one had similar experiences ? please advise on what to do .

My I-140 was approved in May and I am still waiting for I-485 approval. I filed in August 2007 concurrently and my Priority Date is June 2004.
I thought that concurrent filing will also mean concurrent approval, but may be this is not the case. Otherwise should I call NSC and ask them about it (whats the best way to call them ?)

Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

One of my friends was in the same boat as yours and he said YES. No problem in visa issuance. And as per my friend, the officer already knew that he was attending school. I think the schools report all enrollment to USCIS.
Also my wife went for visa interview recently. She is on H4 and she also said yes to Q33.
