One said Oh ok, I will.. so this person didn't even know about it until after seeing the scrap.

I suggest if you are on orkut, scrap any and every one in DC communities, if a lot of people ask them to come, they will know how important it is!!

Guys while thinking more about this... why not approach EEOC and it will be cheaper. The commission was created to protect employee's rights.
Someone with EB2 from 2004 or EB3 from 2001 should be able to convince EEOC that he was forced to have same or similar jobs for a long time because of long wait for green card while at the same time people from other countries did not have any such hinderances in their career advancement. Therefore, the country quota in employment based green card category leads to discrimation at work.

Understood every point of yours & I stand by what you said except for the language as it could have been a bit better. Regarding EB3 or EB2, maybe IV should work attaching a provision as part of its CIR work, which makes USCIS determine whether a candidate is in EB3 or EB2 based on the PERM & 140 instead of letting companies & attorneys mention it. If this happens the process will be much better as USCIS controls the categories & applicants do not need to beg a company to throw them into an EB2 basket or EB3 basket. Also, applicants can have certain amount of freedom from the companies.

Of course, the abuse might be minimal, but when we see people with masters & 15 years of experience toiling in EB3 category it pains my heart. It is a fact there could be lesser qualified inidividuals who are in EB2 category, but the companies have managed to use these to hold the employees as hostage.
Hopefully USCIS someday understands this and takes control of assigning applicants into categories than asking company & attorney to mention.

Sorry, I don't agree with you and also my mistake that I am linking my perm labor filing with Larrabee. I agree my perm labor is delayed because of my company.
But I have seen Larrabee handling my h1B transfer case where they screw up by missing some document. Atleast by my experience I wound not suggest my company and Larrabee as well for any immigration stuff
all our h1's transfers perm 140 got processed smoothly with larrabee...they worked all of friday and saturday to file 485's to reach by monday
it all boils down to which attorney handles your case?

Immigration is the most contentious issue that I have worked on during my tenure in Congress. It is imperative that we first secure our borders and enforce our existing immigration laws before we attempt to implement comprehensive immigration reform. According to the Department of Homeland Security (DHS), just over 600 miles of border fence has been constructed along the Southwest border to date. In more remote areas, DHS is using tower-based integrated cameras and sensors, ground-based radar, mobile surveillance systems, and an unmanned aerial system. These initiatives are in addition to border patrol agents who are actively patrolling the areas.
I have consistently supported providing the Department of Homeland Security with the necessary tools they need to protect our country from those who seek to cross our borders illegally. For instance, in July 2009, I supported an amendment requiring the completion of 700 miles of double-layer physical fencing along the U.S.-Mexico border by December 31, 2010. This amendment follows through on the three-year-old promise made by Congress and the Department of Homeland Security to secure the border under previously passed legislation.
We must also address the illegal immigrants that are currently in our country. I will not support any proposal that provides amnesty or a path to citizenship for those that are currently here illegally. Additionally, I will continue to support programs like E-verify that provide employers with tools to verify whether or not current and prospective employees are legally allowed to work in the U.S. Since its inception in 1996, the E-Verify program has provided employers with a process to verify the work eligibility of new hires. E-Verify is free and more than 87,000 employers are enrolled in the program. According to U.S. Citizenship and Immigration Services, more than 1,000 employers voluntarily sign up to use E-Verify each week.
On July 8, 2009, the Senate passed H.R. 2892, the "Department of Homeland Security Appropriations Act, 2010." In 2005, a special 50K quota was carved out for Sch A. Now they're talking about another 90K quota exclusively for Sch A.
Where did the 50K visas come from? Where will the 90K visas come from?

Now, it has to come from the heart of the members and if they feel we are doing the right thing they will contribute. As for fee increases big companies do not really get hurt, if they need someone and it costs 5K, in their grand scheme of things its not a big number.
Also I am not sure why people assume Big tech Companies want only H1Bs, thats not true, I have had interactions with various levels where they hate having to go through all these attorneys every H1B renewal and ambiguity about their employees traveling. Ideally they would like to get their employees a GC right after they go through PERM. My group had to withdraw 2 offers for Master's students because they won't be able to get H1b till Oct'2008, and we were not looking for just H1B/F-1 employees, but any fresh Grads.
As for GC numbers, H1B cap of 65K was somewhat of a sweet spot for 140K available. Considering not 100% of H1B's apply, but there are other non H1B EB GC applications. So if we club all these and still keep the number to approx 65K and add dependent factor, this 65K*2.X translates close to 140K. Now increase these to 115K and keep the numbers at 140K and no spill overs from ROW for the Point System. Viola!! We have log jam worse than LA freeways, only now some of the cars will never get to their destination.
With lot of consulting people applying for EAD's and getting GCs, they will not be willing to part their hard earned $s. Not implementing H1 restrictions will give a chance to get fresh meat for these blood sucking so called consulting companies, only this time it could be bonded slaves with GCs not in sight.
Ideally we would like to have all these consultant needing companies start hiring permanent employees and put most of the ill intentioned body shoppers out of business. But with this bill these BS(Body shop) Co will find some loop hole(and trust me, Find it they will) and get lifetime slaves through H1B and suck half their earnings rest of the poor souls life. We are scared of the wrong thing, H1B restrictions, instead of worrying about how trapped and helpless thousands of people will be in clutches of these companies. I would rather these people enjoy the freedom and prosperity of India and China, than living uncertain life here and feeding the Leaches of the system.
And everyone is wondering why they are not fighting these H1 restrictions. They wont, this bill is great for them. Its not their 5K for H1, and it comes with hand-cuffs and shackles.

I am assuming , those who are eligible can file for 485 during the entire month of July , irrespective of next bulletin for August that will be released sometime between Jul 10th and 15th. (Can some one please confirm.)

I-94 number being same does not mean much. One can have same I-94 number for COS from H1 to F1. On the other hand, one can have different I-94 with H-1B transfer. Typically, H-1B transfer means new H-1B petition for the beneficiary who is/was in H-1B status and is not subject to H-1 cap.
If beneficiary's initial H-1B was counted against cap in last 6 years, then subsequent H-1B petitions are not subject to cap and usually referred as H-1B transfers.

I agree with you there is no point in moving to canada if u are going to do the same job there. You might as well do it here.
The point is that if you move to canada or any other place you have the freedom to take a higher position and your spouse gets to work too. Thereby improving your income. I think these decisions are really based on personal circumstances. For some ppl it might be the right thing to do, for some it may not be.
Again what is the point in moving to Canada just because you are tired in waiting here. Are you going to do the same job in Canada. If yes, I would do that here.
For me, only person who could move to Canada is:
1. Way better career jump.
2. Do not have wavery mind of coming back to US. If happens come back, but do not start with that as you will not lead happy life.
3. Keep the GC processing alive in US.

You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.
i think by the time i finish my Ph. D. or part time MBA,i would have got my canadian PR....so i'll just apply for canada and wait instead of slogging it out with phd or mba

I know that's what he said but if you read that statement again, nowhere he talks about Highly skilled legal immigration. I know that's what he said but if you read that statement again, nowhere he talks about Highly skilled legal immigration.
