Well said Sir, and now as President-elect, we hope to see some action on above.
This issue I bring to your attention may seem trivial, but throws light on darker side of the life of dependent H4 visa holders, who are mostly women. And since you endorse women empowerment, I believe you will give a serious look at this idea.
Theres a strong lobby support for increasing H-1B visa cap to address the shortage of skilled workers. Theres also a strong lobby opposing it. This idea will satisfy both the lobbies. A very simple way to literally double the number of already available skilled workers in the USA without having to increase the visa cap. Allow me to explain....
Currently the spouse of H-1B holders, the H4 visa holders are not allowed to work. Most of these H4 Visa holders are qualified, skilled and experienced. In one stroke of the pen, by amending this tiny rule allowing H4 visa holders to work, you will facilitate thousands, if not millions of already legal & available skilled workers in the US, to work. Please note that spouse on L2 Spouse/Dependent visas for L1 visa holders (intra company transferee's), ARE allowed to work through an amendment in 2001. And this can be used as a precedent. Even J and E Visa spouses (J2, E2) are allowed to work.
Good For the Economy: While its now a norm to have a dual-income family where the husband and wife both work, its become all the more necessary for a family to just survive through these unprecedented economic times. H1-B visa workers typically stay on for at least 3 years continuously if not extend it for the next available 3 years. All this while, the poor H1B and his family have to get along with just one income. Moreover, the law also forces the skilled and experienced spouse on H4 to idle at home. This I believe is a loss of national productivity. Your statistics will prove how many H-4's are currently idling away in the US.
Good for the Community & Social standing of Women:
To keep the family together, H1 visa holders bring in their spouse on H4 visa. And then, they get locked in the house. Ninety percent of H4 visa holders are women. Women being, more susceptible to domestic violence by the partner, becomes even more prone to violence due to her complete dependence on the spouse. They become prisoners in USA due to spousal abuse and immigration policies that give their husbands complete control over their lives. Yes, the immigration system is broken. The immigrant women get protection under VAWA but non-immigrants are not covered. Even if a law to let the non-immigrant battered women to obtain work permit is introduced, it might not protect women whose cases are dismissed as non-critical. The abuser can further exert his control over the victim and convince her that he has changed so that the victim might not press charges. Thus the abuser gets encouraged to continue violence. Divorce is not an option because most non-immigrants come from third world countries where a divorced women has to bear the social stigma of divorce and will not be protected in her own home country. Because of the long queues for Labor certification application and retrogression of visa numbers, getting an EAD and Green Card takes longer.
Way Forward:
You plan to legalize people living illegally in USA (and working illegally), you plan to give them a low skilled requirement job visa, similar to the H-1B or L-1, only that skills required are low, and you will let their spouses work too. This will mean that the only resident visa holder NOT AUTHORIZED TO WORK will be the H-4 visa holders.
As a tech-savvy President, you may also want to browse this issue on Google groups and hear the voices of depressed, frustrated and more often abused women, here... Oops. I am unable to provide you the link as it appears to violate the change.gov comment policy (?). The group title is misc.immigration.usa and title is Why USA should issue the dependant visa holders work-authorization? Theres another forum under immigrationvoice.org you may wish to look up. We should focus on spreading awareness about IV. I can't believe I was totally unaware of IV's existence until a month back. I haven't done much but felt strongly about what IV's doing. Me and my wife attended the rally and even contributed for the first time ever. We should brainstorm on how we can get more people on board and on how to transform members into contributors.

because for people from Aus, their spouses can work.
There is a different visa category for australians called E1, only THOSE ppl's spouses can work. If an australian is on an H1 his wife cannot work on an H4 either.
In that case you also have to argue, why H4's cant work but L2's can? :)

Congrats on getting your green card and still continue to contribute for the cause of IV. I am also one among who got GC and still do what ever best I can to fight this injustice.

I did a one time $100 contribution during 2007 Fiasco as i know it was all because of IV. I stayed away from Donating to IV after Donor - Non Donor fights.
I know IV is doing wonderful job and i want to chip in here....Before that i want to know if this is separate drive or can i get Donor status?

I don't know the history of BigTime007 postings. Maybe he has said some things in the past that lead to the ban but his most recent post which got him banned seemed just like venting and nothing more.
What I do find annoying though is when ppl whose PD's are in 2006-2007 tell ppl rotting in BEC to "enjoy the ride". I have seen a few threads in the past where someone stuck in BEC was just venting and then ppl come along and tell them to "be happy for others". I don't get it. How is a person who is stuck for years, sees ppl with later cases get interim benefits, supposed to feel happy knowing they will still be stuck. :confused:
I think all these poor souls are looking for is a few words of sympathy and company of ppl in similiar situation (not very different from ppl complaining about retrogression mind you). If we can not do anything to help ppl stuck in those blackhole let's not rub salt into their wounds.
Lastly, regardless of whether you are stuck in BEC or expect to be stuck in retrogression for the next few years, there is no reason to be uncivil.

All,
Is LUD mandetory after finger printing? I applied for EAD for my wife and me on 5/21. Sent supporting docs and had LUD on 5/23. Went for finger printing on 6/10 but no LUD so far. I am concerned if the finger printing center sent the data to USCIS or not. Our EAD expired 7/30 so I am concerned.

my attorny just sent back my DS-230, and just got wait for the dates to br current.
so i can get the last bit at the embassy sorted, and yes i am doing CP, its my only option. and yes i do have all the rellevant experice and qualifications, i never would have got my i140 other wise.
it carnt stay at AUG 02 for ever. it will move, just got to see what happens.
Whether or not you have passed LC and 140 makes no difference on the wait time. I still say about 4 more years unless there is a change in the law. Sorry, I'm rather unfamiliar with the CP side of applications.

Hi,
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.
Here are my questions.
1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?
2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.
3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.
4. Anyother suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

Its illegal to work before the start date mentioned and also since ur I-94 will expire u have to leave the country.
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.
Here are my questions.
1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?
2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.
3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.

No u cannot. Since u said the valid date is from Nov 07.

U have to leave the country and re-enter agin so that u will get a new I-94.

I DISAGREE WITH THE TERM "SELFISH AGENDA". I have read responses form the core team and I understand BEC issues are beyond the scope of IV's goal. However I think we should let BEC impacted members to mobilize, organize and communicate with each other through this forum. I feel strongly for them because I was stuck in BEC for a very long time too, it is an integral part of Employment based green cards to a majority of applicants. Even if we don't support them by being involved since we are not facing those issues, we must sympathize with people affected with BEC backlogs and give them directions, thoughts and good energy and wish them well..
I know behind the scenes core team is providing support, ideas to BEC impacted resources on how to go about and ideas. I think it is just commonsensical that IV cannot take up every issue and fight for everything. So that is why they are focused more on Retrogression caused by visa unavailability as their primary goal!
Hope we stop showing indifference among members and stop going at each other, its not worth dividing groups!

To what one member said; we don't like it both ways. A question to the original poster. Had this been an emergency and USCIS delayed your EAD by three weeks, I bet you would be screaming and yelling at their inefficiency. Yes, the system is broken. Look at the bright side. At least an attempt is being made to fix it. If this were India you would be paying a hefty sum to God knows how many people to get something as simple as a birth certificate. And let me ask you one other question. When was the last time you picked up a phone and called your local MLA hoping that he or she will resolve the water problem in your area? Again, you would be paying decent money and runaround the MLA's private secretary to get ten minutes on the MLA's calendar.
So dude, put-up or shut-up. Things are changing and if you want it any faster then you should give up your day job and dedicate yourself to the cause.
