Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

aman kapoor is the president and founder of iv- of course you can argue he now has his GC but that fact is he is still the heart and soul of iv and runs the organization on a day to day basis. he is EB3.
the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)
no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!
so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.
where were you when USCIS implemented vertical spillover in 2006 and left EB2 I in a U state while giving EB2 Gc numbers to EB3 ROW?

in 2007 ordinarily, (like 06) EB2 I and EB3 I would have got only 2,800 GC each. because of iv's efforts in reversing the july bulletin, EB3 I got a huge number of Gc instead. many more than any other category. i don't remember anyone else standing up and saying that this was unfair and that iv is all about EB3I. and that's what a lot of anti iv folks say. that iv is all about EB3 India. so this is very ironical.
and i see here a comment that every campaign has been bad for EB3 india.
i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

For whatever its worth Compete America has sent another letter supporting the Llofgren bills yesterday. To my knowledge this is the first time they are openly supporting an EM immig relief without asking to increase H1 B numbers.

But we will need enough support to gather a critical mass and start things rolling in the right track.
So can we have a online form where everyone affected can sign in? How do we do that?
Did you talk to IV core about this issue? What is there position on this issue? Have they raised this issued when they lobby/meet conngressman/congresswomwn/senators regarding other agendas. If not may be you can your help to raise this issue when they meet with lawmakers.

My understanding is they wait until last quarter to give the spill over. But this time they started giving the numbers in 3rd quarter itself. Keep in mind EB1 is current and Eb2 except I and C is still current.
I expect to see at least 20k visa's issued to EB2 I and C.
EB2 China wont take much visas because EB2 china PD cut off date was already Jan 2006 a year back. So it takes its reguler 9,800 visas for this 2008 fiscal year.

When I disucss such issues among my Indian friends - people discuss it for sometime and move on to the next topic. if I try to convince people about the seriousness and how everyone should feel bad about it and do something aboout it - all I get from them is "Relax and chill, life goes on - these guys will get some apology"
A lot of Indians are also not vocal about the issues they face. They just absorb it and digest it and pretend as if nothing happened.
If I discuss the samme with non Indian - they will say "You guys must all do something together and stand up against this - I can support you if you all stand up"

Look at the unity in our diversity...for a moment while reading some of the comments I forgot I was in the US and looking at an supposedly elite forum...Bravo!! Keep it up Indians (Tamilians, Gujaratis, Marathis, Bengalis, Biharis, etc..)
One more thing, if you are upset with a person who misbehaved with you (in this case, rudely told you he didn't know any language other than Hindi), then logic tells me I should be upset with that person and not the reason (in this case, language) itself.
I belong to a Hindi speaking part of India, and I have lived in Pune, Bangalore, and Hyderabad. I've had people tell me very rudely to talk in the native languages of these areas and I've tried, sometimes successfully and sometimes, not so much. The rudeness of a few members of the community never led me to form a general opinion. I've very close friends from all over India.
It is my opinion that one should try to learn the local language. It bodes well for everybody and makes life easier. As matured people that we are, I think this is a very trivial issue to fight among ourselves or get emotional.
I never knew Hindi is a local language in US:D Moreover I dont have anything against Hindi or any other language. Its the personal experience with people on more than one occasion.

Good news for some and not so good news for others. I have been waiting for my labor for last 4 years and have still not got the approval on hand. So I am not ready to apply for 485. Where as a friend of mine who came to US last year and applied for labor through perm 2 months back has his approved labor and can apply for 485. I feel this is kind of unfair. The dates should have progressed slowly but steadily instead of trying to create a mad rush now.

At that time there were 3 million undocumented workers in the U.S.; today there are more than 11 million. In Mexico, 9 million more live in poverty than when NAFTA was enacted. By creating an atmosphere where Mexican citizens feel they have no chance of a successful life in Mexico, these ill-conceived trade agreements increase the number of illegal immigrants coming into our country.
In addition to addressing the forces that are compelling illegal immigration, we must take action to bring illegal immigrants out of the shadows. While I do not support amnesty and have serious concerns about guest worker programs, I do believe our nation should consider establishing a process by which illegal immigrants can eventually earn citizenship. The solution to our immigration problem will not be a simple one, as many things in our country need to be fixed to stop illegal immigration. It is time to take a common sense approach to immigration reform.
The Senate most recently considered immigration when S.1639 was introduced in the 110th Congress. On June 28, 2007, the Senate rejected a cloture motion to proceed to final passage of S.1639 by a vote of 46 yeas to 53 nays. I was deeply concerned about the guest worker provisions in this bill, and voted against proceeding to a final vote. My friend, you have not seen the complete posting. I mentioned around 15 times that my lawyer has filed G-28 and AC21 together in May this year.
My lawyer is one of the best in southern California and i am with him since joining new company. He is going to check with TSC for G-28 and if they didn't updated one then i will have no choice but to ask old lawyer to forward the notice to me.
Sorry I missed that part. As you lawyer side is already taken care of, then I guess I would do the same that you have been thinking of doing. Take an infopass appointment, try to get a copy of the denial notice and also check if they have the updated G-28 in your file. By the mean time, let your lawyer do whatever he possibly can.
Also, as a professional courtesy, your lawyer should provide everything to the new lawyer once requested. Hopefully, the old lawyer will maintain the courtesy and won't cause any trouble.

Take an infopass appointment, try to get a copy of the denial notice and also check if they have the updated G-28 in your file. By the mean time, let your lawyer do whatever he possibly can.
Also, as a professional courtesy, your lawyer should provide everything to the new lawyer once requested. Hopefully, the old lawyer will maintain the courtesy and won't cause any trouble.

Berry, Appleman & Leiden LLP is very good firm. I have very good experience with them. They completed all my paper work on Jun 30, so that they can file by July 2. Also the attorney and the para-legal were really good and replied to my questions patiently. The website is http://www.usabal.com/

Are you kidding me? You are recommending http://www.usabal.com/ aka Berry, Appleman & Leiden LLP? DO NOT USE THIS LAW FIRM. RUN AWAY FROM IT AS FAST AS YOU CAN. They totally screwed up my case. My PD became current on June. I asked them repeadtly to file my 485. And I asked them for like 1 1/2 month. But they waited till July to file my case. So, I was affected by this visa fiasco. Their lawyer do not answer phone calls, they don't return voic mail and they do not response to email for 3-4 days. It is a totally BS firm. If possible go with small immigration law firm.

Yes, that is an issue. You will need to get an affidavit. The affidavit can be faxed or scan+emailed over to you.
